1. Acceptance & Regulatory Disclosures

By clicking “I Agree,” checking out, or using greenguard.help, you accept these Terms. GreenGuard is a registered and bonded immigrant assistance service provider (not a law firm; not attorneys; not affiliated with USCIS or any government agency). All USCIS forms and instructions are available for free at uscis.gov.

Multi-State Operations: GreenGuard maintains registrations and surety bonds as required by state law in multiple jurisdictions. Our services are tailored to comply with each state's specific requirements.

California: Registered with California Secretary of State. Surety Bond No. BX0070814.
New York: Operating in compliance with New York state regulations for immigration assistance providers.
Other States: We maintain appropriate registrations and bonds as required by state law in all jurisdictions where we operate.

2. Eligibility

You must be (a) at least 18 years old and (b) authorized to enter these Terms on behalf of yourself and, where applicable, your spouse/partner. You must also reside in selected U.S. states or territories where we are authorized to provide services. If you are outside the U.S., you must not use this service.

Service scope option: If your matter involves adjustment of status (AOS), you represent that you are physically present in the United States. We do not support cases when you are reside abroad.)

3. Service Description – No Legal Advice

GreenGuard provides software‑assisted document preparation. Our fee covers a guided form wizard, data validation, PDF generation, and secure storage. We do not provide legal advice, determine which immigration benefit or form you should select, or represent you before USCIS/EOIR. Consult a licensed attorney for legal advice.

4. Product Workflow

  • Free Questionnaire: You will answer some basic questions about your case and our system will determine if you can use GreenGuard.
  • Contract & Payment: You will review and e‑sign the state-specific immigration assistance service contract (in English and your preferred language if available) and then enter your credit card details. Payment timing varies by state: California clients (and most other states) are charged after 72 hours, New York clients after 3 business days, unless you cancel.
  • Wizard & Autosave: Complete steps for I‑130, I‑130A, I‑485, I‑765, and/or I‑131; progress autosaves and you may return anytime.
  • Validation & Data Lock: When forms pass final checks, your answers are locked to preserve integrity. You may use “Save & Quit” to return to your dashboard.
  • Preview: For protection before payment, previews are watermarked.
  • Accuracy Confirmation: you must confirm that your information is accurate. After confirmation, forms are permanently locked and edits require contacting GreenGuard team.

5. Your Responsibilities; Preparer & Interpreter

  • Provide accurate, current information; review each generated form for mistakes before filing; keep your login secure.
  • No Legal Advice: Do not rely on us for legal advice or for selecting forms/benefits.
  • Preparer (USCIS forms): By default, you are the preparer. If you explicitly opt in for transcription/assistance beyond self‑service, GreenGuard will designate a named employee to complete and sign the preparer section with:
    • Name of preparer (individual employee)

  • Interpreter: We do not provide interpreter services. If you require an interpreter, you must arrange one.

6. Fees, Receipts, Refunds & State-Specific Cancellation Rights

Fees are due at checkout via our payment processor (e.g., Stripe). You will receive a computer‑generated receipt on our letterhead for each payment. Cancellation rights vary by state:

  • California Clients: You may rescind the Contract within 72 hours of signing for a full refund.
  • New York Clients: You may rescind the Contract within 3 business days (excluding weekends and federal holidays) of signing for a full refund. Payment will be automatically processed at 12:00 AM Eastern Time on the 4th business day.
  • Other States: Cancellation periods as specified in your state-specific contract.

After the cancellation window, we will correct without charge—or, at our option, refund—any error solely our fault reported within 30 days of purchase. All other refunds are discretionary.

7. Electronic Signatures & Communications

By using the service, you consent to transact electronically. Before consenting, we present hardware/software requirements for accessing and retaining electronic records. You may withdraw consent at any time by emailing info@greenguard.help; withdrawal does not affect prior records. You may request paper copies (a reasonable fee may apply unless prohibited by law).

8. Records, Copies & Data Retention

We will deliver to you an electronic copy of each document we complete on your behalf and will retain copies of your forms and related records for at least three (3) years after the last service to you, as required by law. For your convenience and for our records, a copy of the generated PDF is stored securely. Account deletion in your dashboard performs a soft delete (you cannot log in) but certain records may be retained for compliance, security, and record‑keeping purposes.

9. Intellectual Property

All site content and software are owned by us or our licensors. We grant you a limited, personal, non‑transferable license to use the service solely to prepare your own immigration filings.

10. Prohibited Uses

You will not misuse the service (e.g., reverse engineer; infringe IP; upload malicious code; violate law; misrepresent identity; or use the service to provide legal advice without authorization).

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT GUARANTEE OUTCOMES WITH USCIS OR ANY AGENCY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE EVENT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

13. Indemnification

You will defend, indemnify, and hold harmless GreenGuard and its affiliates from any third‑party claim arising out of your breach of these Terms, misuse of the service, or violation of law.

14. Governing Law & Dispute Resolution

California law governs these Terms. Mandatory Binding Arbitration: Except for claims that may be brought in small claims court, any dispute will be resolved by a single arbitrator through JAMS under the JAMS Streamlined Rules and Consumer Minimum Standards. The hearing will occur in a reasonably convenient location for you or by video at your election. Your arbitration filing fee is capped at $250; GreenGuard pays the remaining JAMS and arbitrator fees. No class actions or jury trials. Either party may seek injunctive relief in court to protect confidential information or intellectual property.

15. Termination

We may suspend or terminate your account for breach of these Terms or to protect the service. You may close your account anytime through the dashboard or by email (soft delete as described above).

16. Modifications

We may update these Terms by posting a new version and notifying active users by email. Continued use after the effective date constitutes acceptance.

17. Entire Agreement; State‑Specific Terms

These Terms, our Privacy Policy, and the state-specific Immigrant Assistance Service Contract (executed at checkout) are the entire agreement between you and GreenGuard. Each state has its own contract version with specific terms, cancellation periods, and regulatory disclosures as required by state law. These state-specific terms will be presented at signing and supersede any conflicting general terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
